Upon the foregoing cited papers, plaintiff moves for summary judgment pursuant to CPLR § 3212, and defendant cross-moves to compel depositions of plaintiff, plaintiffs assignor, and plaintiffs treating physicians pursuant to CPLR § 3124 and 3126. For the following reasons, plaintiffs motion is granted, and defendants motion is denied as moot.
